Terms of Service

The terms on which you can use MXR World — what you may do with the music, what happens to the memories you share, and the limits on both sides.

1. The agreement

These terms govern your use of www.mxr.digital (“MXR World”, “the platform”), operated by MXR World (“MXR”, “we”, “us”).

By using the platform or creating an account, you agree to them. If you do not, please do not use the platform.

Our Privacy Policy forms part of these terms and explains what we do with your personal information.

2. Who may use it

  • You must be at least 16 years old to create an account.
  • If you are under 18, you need the consent of a parent or guardian.
  • You may hold one account. Please do not create accounts for other people, or share yours.
  • You are responsible for what happens under your account, so keep your password to yourself and tell us if you think someone else has it.

3. What you may do

You may stream, explore and enjoy everything on the platform for your own personal, non-commercial listening. That is what it is for.

Where a mix or release is made available for download, you may download it and keep it for your own listening.

4. What you may not do

  • Re-upload, redistribute, sell or otherwise share the audio you download from MXR World. It is for you, not for onward distribution.
  • Use MXR music in any commercial context — advertising, film, video, streaming content, live sets sold as recordings — without written permission. Ask us; the answer is often yes.
  • Remix, sample, edit or otherwise create derivative works from MXR music without written permission.
  • Strip, circumvent or work around any access control, download gate or signed link.
  • Scrape, crawl or bulk-extract content, or use automated tools against the platform.
  • Attempt to gain access to accounts, systems or data that are not yours.
  • Interfere with the platform's operation, including by overwhelming it with requests.
  • Impersonate MXR or any other person, or misrepresent your association with us.

5. Memories and other things you submit

The Memories feature exists so listeners can attach their own stories to music. When you submit a memory, feedback, or anything else:

  • You keep ownership of what you wrote. It stays yours.
  • You grant us a non-exclusive, royalty-free, worldwide licence to display, store and share it on the platform and in MXR's own channels, for as long as it remains published.
  • You confirm it is yours to submit, and that publishing it will not infringe anyone else's rights or privacy.
  • You agree not to submit anything unlawful, hateful, harassing, defamatory, or that reveals someone else's personal information without their agreement.
  • We may decline to publish, or later remove, anything at our discretion — most often because it names a third party who has not agreed to appear.
  • You can ask us to remove something you submitted at any time by writing to us.

6. Our music and everything around it

All music, mixes, artwork, photography, writing, design and code on MXR World belongs to MXR or is used with permission. Nothing in these terms transfers any of it to you.

Access to the platform is a limited, personal, revocable, non-transferable licence to use it as described here. It is not a sale, and it is not a licence to the underlying works.

Third-party material — including tracks featured within mixes and content shown through embedded Spotify, YouTube, Instagram and TikTok players — remains the property of its respective owners.

7. Third-party services

Parts of the platform depend on services we do not control: Spotify, YouTube, Instagram and TikTok embeds, and Google sign-in.

Your use of those is subject to their own terms and privacy policies. We are not responsible for their content, availability or behaviour, and an embed breaking is not a failure of this agreement.

8. Availability, and the fact that this is early

MXR World is under active development. Features will appear, change and occasionally be withdrawn. Some of it is in beta and may behave unpredictably.

We aim to keep the platform available, but we do not guarantee uninterrupted or error-free service. We may suspend access for maintenance, or to protect the platform, with as much notice as circumstances allow.

The platform is provided “as is”. To the fullest extent permitted by law, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

9. Liability

Nothing here limits liability that cannot lawfully be limited — including for death or personal injury caused by negligence, or for fraud. Your rights under the Consumer Protection Act 68 of 2008 are unaffected.

Subject to that, we are not liable for indirect or consequential loss, loss of profits, loss of data, or loss arising from your inability to access the platform.

You use content you download at your own risk, and are responsible for how you use it.

10. Ending it

  • You can delete your account at any time from your profile. Doing so removes your personal information as described in the Privacy Policy.
  • We may suspend or terminate your access if you materially breach these terms — most obviously by redistributing downloads or attacking the platform.
  • Where circumstances allow, we will tell you why and give you a chance to put it right first.
  • Ending your account does not affect the licence you granted us over anything you had already published, unless you ask us to remove it.

11. Changes to these terms

We will update these terms as the platform develops. The date at the top always reflects the current version.

If a change materially affects your rights, we will tell you by email rather than quietly editing this page. Continuing to use the platform after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute.

If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your own country.
